Appeal Process

Disability Appeals in Cincinnati

At David W. Kapor & Associates in Cincinnati, we have had success helping many clients qualify the first time they apply. We have helped many others obtain benefits by filing appeals after their claims have been denied on initial application and on reconsideration.

The Process For Appealing A Denied SSD Claim

You may have heard that most initial applications for Social Security Disability (SSD) benefits are denied. Indeed, there is a high statistical probability that your claim will be denied on initial application and on reconsideration regardless of merit.

In the event that your initial application for benefits is denied, you may file an appeal, also known as a Request for Reconsideration. If your claim is denied on reconsideration, the next step is to appeal this denial and file a Request for Hearing. All appeals must be filed within 60 days commencing from the date of the notice denying the claim. We file the appeals.

We Know The Keys To A Successful Appeal

There are a number of reasons that initial claims are denied and may later be approved through the administrative process. We often find that our clients encounter difficulty finding appropriate doctors and communicating thoroughly with their doctors. Advising clients on these critical matters is part of what we do at David W. Kapor & Associates.

Our success in disability claims at David W. Kapor & Associates is not only a result of technical knowledge but skillful, aggressive advocacy in hearings. It has to do with in-depth understanding of each client's case that we make it a top priority. We meet with clients face to face, get to know them as real people with names (not case numbers) and stay in close communication with them throughout their cases. Strong attorney-client relationships help build successful claims by lawyers of David W. Kapor & Associates.

We Can Help You Determine If You Are Eligible

We bring SSD appeals on behalf of workers with physical and mental impairments. We only take cases when we feel confident that we can bring about success. Our SSD legal services are delivered on a contingency fee basis. Attorneys' fees are 25 percent of any retroactive benefits owed, with a cap of $6,000, whichever is less. We are paid nothing upfront and charge no attorney fees unless we are successful in helping you obtain disability benefits
